Acceptable Use Policy

This acceptable use policy sets out how you may use our website at www.breathfinder.io (our site). It applies to everyone who visits or uses our site, including subscribers (breath coach or practitioners registered on our site).  By using our site you accept, and agree to keep to, this acceptable use policy, which applies alongside our website Terms of Use.

Our site at www.breathfinder.io is owned and operated by us, BreathFinder Ltd. We are a private limited company incorporated in Jersey, Channel Islands under company registration number 135013, and our registered office is Plat Douet Rd, St. Saviours, Jersey, JE2 7PN.

2.  Communications:

By creating an account on our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

  

3.  Interactive services:

From time to time we may provide interactive services on our site, including chat rooms and bulletin boards. If we do provide any interactive service, we will give you clear information about the kind of service we offer, if it is moderated (overseen and monitored) and what form of moderation is used (including whether it is human or technical).

We will do our best to assess any possible risks for users (particularly children) when they use any interactive service provided on our site, and in each case we will decide whether it is appropriate to moderate the relevant service (and if so, what kind of moderation to use). However, we are under no obligation to moderate any interactive service we provide, and we are not liable for any loss or damage arising from any interactive service being used in a way that does not meet our content standards, whether the service is moderated or not.  If we do moderate an interactive service, we will normally let you know how to contact the moderator if you have any concerns.

4.  Contests, Sweepstakes and Promotions:

Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through the Service may be governed by rules that are separate from these Terms & Conditions. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms and Conditions, the Promotion rules will apply.

5.  Reviews:

  • When a customer engages in work for a breath Coach or Practitioner, the customer has the right to express an opinion / feedback / comment on the services performed. This is referred to as review.
  • A customer is entitled to add a review to the profile of the Breath Coach or Practitioner (Subscriber) whom rendered services. The customer warrants that the information in a review is provided in good faith and is accurate. A review by a customer may not be personal, defamatory, vulgar, obscene and/or racist. The customer must give a clear and concise review of the service provided by the Breath coach or Practitioner and/or a general impression. This is to ensure maximum transparency for future customers.
  • Breath Coaches or Practitioners agree to submit themselves to a forum / platform for review by customers with the aim of positive feedback where review by satisfied customers will create more leads / referrals when registering with BreathFinder Ltd.
  • Breath coaches or Practitioners also accept the risk of negative review from customers.
  • A Breath coach or Practitioner has the right to post a short response to any review by a customer.
  • The review may only be posted at completion of the service provided by the Breath Coach or Practitioner and after the customer paid for the services in full. If a dispute arises before the service is completed, the review posted will be limited to “Customer involved in pending dispute with the Breach Coach or Practitioner.” Please see our Resolving Issues Policy for more information on how disputes are handled.
  • It is not permitted to post a review before the work is fully completed and paid.
  • Reviews are composed of a positive, negative or neutral rating and a short comment or expression of the customer’s opinion. BreathFinder Ltd reserves the right to edit same in its sole and exclusive discretion, [without having any obligation to do so and/or accepting any liability whatsoever for not editing same].
  • BreathFinder Ltd is entitled [but not obliged] at all times to remove a reference from the Website. In the following cases BreathFinder Ltd may consider to remove a review:
  • In terms of a court order.
  • If the review contains libellous, discriminating, vulgar, obscene or racist language and / or personal data or links to other websites / pages or scripts.
  • If, in the sole discretion of BreathFinder Ltd, there is an abuse of the Website and services. 

6.  Content standards:

These content standards apply to any material you contribute to our site (contributions), and to any interactive services associated with it. You must meet the following standards. The standards apply to all of, and each part of, any contribution.

Contributions must:

  • be accurate (where they state facts);
  • be genuinely held (where they state opinions); and
  • keep to all relevant laws that apply in any country the contribution was created in or posted from.

Contributions must not do the following.

  • Contain any material which damages a person’s reputation.
  • Contain any material which is obscene, offensive, hateful or inflammatory.
  • Promote sexually explicit material.
  • Promote violence.
  • Promote discrimination based on race, sex or gender, religion, nationality, disability, sexuality or age.
  • Break, limit or undermine any other person’s copyright, database right or trademark.
  • Be likely to deceive any person.
  • Fail to meet any legal duty you owe to a third party, such as a duty under a contract or an obligation to keep anything confidential.
  • Promote any illegal activity.
  • Be threatening or abusive, invade another’s privacy, annoy or inconvenience anyone, or cause needless anxiety.
  • Be likely to harass, upset, embarrass, alarm or annoy any other person.
  • Be used to impersonate any person, misrepresent your identity or misrepresent an association with any person.
  • Give the impression that they come from us, if this is not the case.
  • Support, promote or help with any unlawful act, such as computer misuse or breaking, limiting or undermining a copyright.

7.  Prohibited uses:

You must not use our site in the following ways.

  • In any way that breaks any relevant local, national or international law or regulation that applies.
  • In any way that is (or is intended to be) unlawful or fraudulent, or has any unlawful or fraudulent effect.
  • In any way that harms, or could harm, minors (people under 18).
  • To send, knowingly receive, upload, download, use or reuse any material which does not meet our content standards.
  • To send, or help in sending, any unsolicited or unauthorised advertising or promotional material (spam).
  • To knowingly send or upload any data or material that contains viruses, Trojans, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or computer code designed to damage the usability or functions of any computer software or hardware.

Also, you must not do the following.

  • Reproduce, copy or resell any part of our site, if this does not keep to our website terms of use.
  • Interfere with, damage or disrupt:
    • any part of our site;
    • any equipment or network our site is stored on;
    • any software used to provide our site; or
    • any equipment, network or software owned or used by any third party; unless you have all the permission you need.

8.  Accounts & Passwords:

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

  • You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service.
  • You may not use as a username, identification the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorisation. You may not use as a username any name that is offensive, vulgar or obscene.
  • We reserve the right to refuse service, disable or terminate accounts, remove or edit content, or cancel orders in our sole discretion at any time if in our reasonable opinion, you have failed to keep to these terms of use.
  • You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
  • If you think or know that anyone other than you knows your username, identification or password, you must tell us as soon as reasonably possible via email or live chat on our website.

9.  Suspension and termination:

If we decide that your use of our site does not keep to this acceptable use policy, we may take whatever action we consider appropriate.

If you do not keep to this acceptable use policy, you will have broken our website terms of use, which may result in us doing any or all of the following.

  • Temporarily or permanently withdrawing your right to use our site, without giving you notice.
  • Temporarily or permanently removing any material or contribution you have posted or uploaded to our site, without giving you notice.
  • Give you a warning.
  • Recover all our costs (including, but not limited to, reasonable administrative and legal costs) that have arisen as a result of you breaking the website terms of use.
  • Take legal action against you.
  • Give law-enforcement authorities any information they reasonably need.
  • Take any other action we think is necessary.

We will not be liable for any action we take in response to you not keeping to this acceptable use policy, and we may take any lawful action we consider appropriate.

10.  Modifications to the Terms:

BreathFinder Ltd does not warrant the accuracy, adequacy or completeness of material on this website. All information may be changed, supplemented, deleted or updated without notice at the sole discretion of BreathFinder Ltd.  Please check these terms of use from time to time to take notice of any changes we made, as these are binding on you.
